THESE TERMS CONTAIN A PROVISION REQUIRING MANDATORY ARBITRATION OF CLAIMS THAT, EXCEPT WHERE PROHIBITED BY APPLICABLE LAWS, REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE CLAIMS, RATHER THAN JURY TRIALS OR CLASS ACTIONS.
360mods protects and connects your loved ones, pets, and important items to make your life easier, safer, and less stressful. These Terms apply to the websites, mobile apps, watch apps, Help Center, and other associated services provided by 360mods, Inc., a Delaware corporation ("360mods" or “Company”), and 360mods’s subsidiaries, Tile and Jiobit.
I. USE OF THE SERVICES
A. Eligibility
The Products and Services are intended for use by individuals and families. Accounts and subscriptions for 360mods Services must be owned and operated by an individual who provides accurate information during account registration. You may use the Products and Service only if you can form a binding contract with 360mods in compliance with applicable laws.
Anyone under thirteen (13) years of age (fourteen in Korea) is strictly prohibited from creating an account without explicit parental consent. By providing consent, parents or legal guardians agree to exercise oversight of the minor's usage.
B. Prohibited Uses
You agree not to engage in any prohibited activities, including:
- Copying, disassembling, decompiling, scraping, or creating derivative works of the Services;
- Imposing an unreasonable load on 360mods servers through automated bots or scripts;
- Uploading invalid data, viruses, worms, or malicious software agents;
- Harvesting personal information of other members without authorization;
- Using the service for unlawful surveillance, stalking, harassment, or commercial fraud.
II. SERVICE AVAILABILITY AND TERMINATION
We may modify or improve features of the Services to enhance security, comply with regulatory requirements, or prevent abuse. You may terminate your relationship with 360mods at any time by closing your account through the mobile app settings.
III. MEMBER CONTENT AND INTERACTIONS
You retain ownership rights over photos, comments, and profile information you choose to upload ("Member Content"). By sharing Member Content, you grant 360mods a worldwide, non-exclusive license to process and deliver your content in connection with providing family location features and emergency alerts.
V. TERMS SPECIFIC TO MOBILE SOFTWARE
360mods grants you a non-exclusive, non-transferable, revocable license to install and run the 360mods mobile app on compatible iOS and Android devices owned or controlled by you.
VIII. BILLING, PRICING AND PAYMENT TERMS
Paid memberships (Silver, Gold, Platinum) are billed automatically on a recurring monthly or annual subscription cycle until cancelled. Free trial promotions will transition to standard billing upon conclusion of the trial period unless cancelled prior to renewal.
X. DISPUTE RESOLUTION AND MANDATORY ARBITRATION
You and 360mods agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be resolved by binding, individual arbitration rather than in court, to the fullest extent permitted by applicable law.
